Official Rules

NO PURCHASE NECESSARY TO PARTICIPATE. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID OUTSIDE THE 50 UNITED STATES & D.C. AND WHEREVER PROHIBITED. Say Cheese on RoadsideAmerica.com ("Contest") is open only to legal residents of the 50 United States and D.C. who are 18 years of age or older (see further eligibility restrictions in Rule 4 below). Contest begins at 12:00:01 AM EasternTime ("ET") on 11/20/07 and ends at 11:59:59 PM (CE) on 12/06/07 ("Promotion Period").

1. TO ENTER: Use the contest form on the RoadsideAmerica.com Say Cheese Contest page to submit a recognizable digital photo of you and/or your immediate family posing at an offbeat tourist attraction of the kind featured on RoadsideAmerica.com. The tourist attraction in your photo must be located in the United States or Canada. If you have submitted photos to RoadsideAmerica.com in the past for consideration for inclusion in our content, you may resubmit them as part of your contest entry. For purposes of these rules, "immediate family" is defined as including spouse, parents or legal guardians, siblings, children, step-parents, step-siblings, step-children, and the spouses of each of the foregoing. If the photo includes children from your “immediate family” who are under the age of 18, with your submission you are providing us with permission to publish the photo and representing that you have the legal right to give such permission. With your submission, you are also granting us permission to publish your photo on RoadsideAmerica.com (see terms and conditions for photo submissions and Rule 5 – GENERAL below) without further compensation, except where prohibited. The entry is not valid unless you submit via the email method provided a digital photo in .jpg or .jpeg format that conforms to the above criteria, and your correct email address is provided.
2. PRIZE WINNER SELECTION: The winner will be randomly selected from all valid entries, and is not based on the artistic or any other quality of the photo submitted. The winner will be notified by email. If the email address provided by the entrant is not valid, the entry will be voided and another winner will be selected. Limit one (1) Entry per person/household during the Promotion Period. All registration information must be completed in full. By entering, you agree to allow Sponsor to contact you at any time regarding the Contest.
3. PRIZES: One (1) RCA Small Wonder EZ201 video camera. Approximate retail value: $130. Each winner will be responsible for all federal, state and/or other income taxes on prize. Prizes are non-transferable and no substitutions or cash redemptions will be made except as provided herein or at Sponsor's sole discretion. Sponsor reserves the right to substitute any listed prize or portion of a prize for one of equal or greater value if the designated prize or portion of a prize should become unavailable for any reason. Winners must comply with all Contest rules as published. If a winner is found to be in violation of any contest rules, he/she will be required to forfeit his/her prize, or, at Sponsor's discretion, to reimburse Sponsor for the stated value of the prize if such violation is found after the prize has been used. If a prize is forfeited for any reason, an alternate winner will be drawn at random from among the remaining eligible entries received and awarded the prize. Unless otherwise noted, allow approximately 4 to 6 weeks for shipment of prizes following E-mail notification. Only the prize manufacturer's guarantees and warranties apply to prize, and the prizes are subject thereto. By accepting a prize, the winner agrees to look solely to such manufacturers for any such warranty or guarantee claim.

ELIGIBILITY: Employees of Thomson, Inc., its affiliates, subsidiaries, agents, retailers, distributors, sales representatives, advertising, promotion, public relations and judging agencies, video hosting company and members of the immediate families or households (whether related or not) of any of the above are NOT eligible to participate. Principals of RoadsideAmerica.com and members of their immediate families are NOT eligible to participate. For purposes of these rules, "immediate families" is defined as including spouse, parents or legal guardians, siblings, children, step-parents, step-siblings, step-children, and the spouses of each of the foregoing.
5. 5. GENERAL: Prizes must be accepted as awarded. Acceptance of a Contest prize will further constitute and signify the Winners' agreement and consent (or that of parent or legal guardian if Winner is a minor) that the Sponsor and/or Sponsor's assignee may use the winner’s name in a list of winners to appear on RoadsideAmerica.com or use the winner’s photo submission on RoadsideAmerica.com without further compensation, except where prohibited. BY PARTICIPATING IN THIS CONTEST, ENTRANTS AGREE TO BE BOUND BY THE OFFICIAL RULES AND TO RELEASE AND HOLD HARMLESS SPONSOR, ITS RELATED COMPANIES, AND EACH OF THEIR RESPECTIVE SUBSIDIARIES, AFFILIATES, ADVERTISING, PROMOTION, JUDGING AGENCIES, DIRECTORS, OFFICERS, PRIZE SUPPLIERS, EMPLOYEES, AND AGENTS FROM AND AGAINST ANY LIABILITY WHATSOEVER FOR ANY CLAIMS, COSTS, INJURIES, LOSSES OR DAMAGES OF ANY KIND ARISING OUT OF OR IN CONNECTION WITH PARTICIPATION IN THE CONTEST, OR THE DOWNLOADING, ACCESSING OR SUBMISSION OF ENTRY MATERIALS, OR THE ACCEPTANCE, POSSESSION OR USE/MISUSE OF ANY PRIZE AWARDED HEREIN, ANY SERVICES PROVIDED BY PARTIES OTHER THAN SPONSOR IN CONNECTION WITH THE PRIZE AWARDED, OR PARTICIPATION IN ANY PRIZE-RELATED ACTIVITY OR ANY TRAVEL RELATED THERETO OR USE OF ANY ENTRY (INCLUDING, WITHOUT LIMITATION, CLAIMS, COSTS, INJURIES, LOSSES OR DAMAGES RELATED TO PERSONAL INJURIES, DEATH, DAMAGE TO, LOSS OR DESTRUCTION OF PROPERTY, RIGHTS OF PUBLICITY OR PRIVACY, DEFAMATION OR PORTRAYAL IN A FALSE LIGHT). If for any reason this Contest is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, Sponsor reserves the right at its sole discretion, to disqualify any individual who tampers with the Entry process, and to cancel, terminate, modify or suspend the Contest. Proof of entering information on Sponsor's website is not considered proof of delivery or receipt by Sponsor. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Sponsor is not responsible for electronic transmissions or entries that are lost, late, stolen, incomplete, illegible, damaged, garbled, destroyed or misdirected, or for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or Entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any Web site, or any combination thereof, or for any injury or damage to participant's or any other person's computer relating to or resulting from participation in this Contest or the downloading or accessing of any materials in this Contest. Sponsor is further not responsible for incorrect or inaccurate Entry information whether caused by Internet users or by any of the equipment or programming associated with or utilized in the Contest or for any technical or human error, which may occur in the transmission, receipt or processing of entries. All incomplete or otherwise non-conforming entries will be disqualified.
